Florida and Texas are the two large markets in that table still open to the full strength range. Every other row represents a legislature that decided a percentage test was insufficient and added a quantity test on top.
The vetoed bill and the failed amendment
Two events shaped the current position. Senate Bill 1698 would have imposed strict caps on hemp derived THC products and was vetoed by Governor DeSantis in 2024, on the reasoning that it would have damaged a substantial small business sector without a matching public benefit. Separately, the 2024 ballot measure to legalise adult use marijuana in Florida won a majority but fell short of the 60 percent threshold Florida requires for constitutional amendments.
